Terms of Service

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Platform. By using the Platform, you represent that you meet this requirement and have the authority to enter into these Terms.

2. Account Registration and Security

• You may need to create an account to access certain features.
• You agree to provide accurate, current information and to keep it updated.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• Notify us immediately at info@gidastudios.co.za of any unauthorized use or security breach.

3. Subscription Plans and Billing

• Access to premium features requires a subscription, billed through Apple's App Store or Google Play.
• Subscription options (monthly, yearly, lifetime) and current pricing are displayed within the app. Taxes or currency fees may apply based on your location.
• Auto-renewing plans renew automatically unless canceled at least 24 hours before the current period ends. Your App Store or Google Play account will be charged for renewal within 24 hours prior to period end.
• Manage or cancel subscriptions through your store account settings:
  • iOS: Settings > Apple ID > Subscriptions
  • Android: Google Play > Profile > Payments & Subscriptions
• Lifetime purchases are one-time payments that do not renew.
• We do not issue refunds for subscription periods already billed; refund requests must be submitted through the respective app store.

4. Acceptable Use

You agree not to:

• Reverse engineer, copy, or resell any part of the Platform.
• Bypass security or attempt unauthorized access.
• Use the Platform to transmit harmful content or violate laws.
• Use the Platform for purposes other than agricultural management and assistance.

We reserve the right to suspend or terminate accounts violating these Terms.

5. Data and Consent

Your personal information is handled in accordance with our Privacy Policy. By using the Platform, you consent to the collection and processing of your data as described there.

6. Intellectual Property

All content, trade names, logos, and software on the Platform are owned by us or our licensors and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Platform for its intended purpose. You may not reproduce or distribute our content without written permission.

7. Disclaimers

• The Platform is provided "as is" and "as available," without warranties of any kind, express or implied.
• Agricultural calculations and recommendations are for informational purposes only. You are responsible for validating calibration results and complying with local regulations.
• We do not guarantee that the Platform will be error-free, uninterrupted, or that results will meet your specific requirements.

8. Limitation of Liability

To the fullest extent allowed by law:

• We are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
• Our total liability for any claim related to the Platform will not exceed the amount paid by you to us in the 12 months preceding the claim, or ZAR 1,000 if greater.
• Some jurisdictions do not allow certain limitations; those limitations may not apply to you.

9. Termination

You may stop using the Platform at any time. You may request account deletion within the app via Account & Legal > Delete Account, which removes your profile and associated data. We may suspend or terminate access if you violate these Terms or for operational reasons.

10. Changes

We may update these Terms from time to time. The "Last updated" date will reflect the latest revision. Continued use after changes become effective constitutes acceptance of the new Terms.

11. Third-Party Services

The Platform may link to third-party websites or services. We are not responsible for third-party content, terms, or practices. Use them at your own risk.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the competent courts located in South Africa, unless otherwise required by applicable consumer protection laws.
